1. Acceptance of Terms

By accessing or using Bhakari ("Platform"), you agree to be legally bound by these Terms. If you do not agree, you must not use the Platform.

2. Nature of the Platform

Bhakari is a digital marketplace that connects farmers and consumers. Bhakari:

  • Does NOT own, produce, or control any products listed
  • Acts solely as an intermediary platform
  • Does NOT guarantee the authenticity, quality, or legality of products

3. User Responsibilities

Users agree:

  • To provide accurate, truthful, and complete information
  • Not to impersonate farmers or misrepresent identity
  • Not to sell resold, non-farm-origin products while claiming to be farmers
  • Not to engage in fraudulent, misleading, or illegal activities

4. Farmer Declaration

By registering as a farmer, you explicitly declare:

  • You are the actual producer or directly involved in production
  • Products listed are genuinely farm-produced by you or your farm
  • You are not acting as a middleman or reseller unless explicitly disclosed

Warning: Providing false declarations may result in immediate account suspension, permanent ban, or legal action if damages occur.

5. Verification Disclaimer

Bhakari may perform basic or advanced verification. However:

  • Verification is NOT a guarantee of authenticity
  • Bhakari is not liable for misrepresentation by users
  • Users interact and transact at their own risk

6. Transactions & Liability

  • Bhakari is NOT a party to transactions between users
  • Bhakari is NOT responsible for product quality, delivery failures, misrepresentation, or financial losses

7. Prohibited Activities

Users must NOT:

  • Misrepresent themselves as farmers
  • Sell counterfeit or non-agricultural goods
  • Manipulate pricing or listings fraudulently
  • Use fake documents for verification

8. Suspension & Termination

Bhakari reserves the right to:

  • Suspend or terminate accounts at its sole discretion
  • Remove listings without notice
  • Block users suspected of fraud

9. Limitation of Liability

To the maximum extent permitted by law, Bhakari shall not be liable for indirect, incidental, or consequential damages. Total liability shall not exceed the amount paid to Bhakari (if any).

10. Indemnification

Users agree to indemnify Bhakari against:

  • Claims arising from misrepresentation
  • Fraudulent activities
  • Violation of these terms

11. Governing Law

These Terms shall be governed by the laws of Nepal.

12. Changes to Terms

Bhakari may update these Terms at any time. Continued use constitutes acceptance.
